User Agreement & Rental Terms

1. Agreement & Overview

Welcome to After The Tone ("we", "our", or "us"). This User Agreement & Rental Terms ("Agreement") governs the rental of our vintage telephone audio guest books, 8-inch HD video guest books, photo printing hardware, and related digital archiving services across Toronto and the Greater Toronto Area (GTA).

By reserving an experience, signing a digital contract, submitting payment, or using our website (https://afterthetone.ca), you ("Client", "Rentee", or "User") agree to be bound by these terms.

2. Reservations, Deposits & Payments

  • Date Lock Deposit: To lock in and secure your celebration date on our equipment calendar, a non-refundable deposit is required upon digital agreement signing. Deposit amounts are specified per catalog product and rental scope.
  • Balance Due: The remaining balance of your rental fee (including any custom add-ons, extra rental hours, or extended travel fees) is due 14 days prior to your scheduled event date, or immediately upon booking if reserved within 14 days.
  • Payment Methods: We accept major credit cards (Visa, Mastercard, American Express) processed securely via Stripe, and verified Interac e-Transfers where arranged.

3. Delivery, Setup & Venue Access

  • White-Glove GTA Delivery: We provide complimentary delivery, tabletop positioning, audio/video testing, and post-event teardown pickup throughout Toronto and standard GTA municipalities.
  • Venue Access: The Client is responsible for coordinating venue access for our concierge setup team at least two (2) hours prior to guest arrival.
  • Placement Requirements: The Client must provide a stable, sheltered tabletop or pedestal. While our retro audio guest books feature 24+ hour battery operation, video guest books and photo printers require access to a standard 120V electrical outlet within 15 feet.
  • Outdoor Celebrations: Equipment must be fully sheltered from precipitation, excessive moisture, and direct direct sunlight.

4. Equipment Care, Damage & Theft

Our hardware stations are precision-crafted recording instruments. While standard cosmetic wear from normal guest interaction is anticipated and covered:

  • The Client assumes custody and responsibility for the rented equipment from the time setup is completed until collected by our staff at teardown.
  • In the event of severe physical damage, liquid spills, vandalism, loss, or theft during the rental window, the Client agrees to be responsible for the fair replacement or professional repair costs.
  • Guests must not tamper with internal software settings, camera hardware, or electrical power adapters.

5. Cancellations & Rescheduling Policy

  • Rescheduling: We understand event dates change. You may reschedule your booking to any available future date within 12 months with at least 30 days written notice, with your full deposit transferred at no penalty.
  • Client Cancellations: If you cancel your reservation more than 30 days prior to the event, any payments made beyond the non-refundable deposit will be refunded. Cancellations made within 14 days of the event are non-refundable as equipment and staffing have been exclusively reserved.
  • Force Majeure: Neither party shall be held liable for failure to perform due to acts of God, severe weather emergencies, natural disasters, or venue closures beyond reasonable control. In such events, rental credits or date transfers will be provided.

6. Digital Archive Delivery & Content

  • 48-Hour Turnaround: Our audio and video engineering team polishes and formats every individual voicemail and video clip. Within 48 hours following your celebration, you will receive private portal access to download your entire high-resolution digital archive.
  • Guest Content Disclaimer: After The Tone provides the hardware recording medium only. We are not responsible for the content, language, toasts, roasts, or statements recorded by your guests.
  • Hosting Period: Files remain downloadable via your private link for 90 days. We recommend downloading and backing up all files upon receipt.

7. Limitation of Liability

In the unlikely event of hardware malfunction or unforeseen technical failure that prevents recording during your event, our total liability shall be strictly limited to a prompt full refund of the rental fee paid for the impacted equipment. We shall not be liable for indirect, incidental, or consequential damages.

8. Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario.
